The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 308, 325 and 324 of the Indian Penal Code. The prosecution case as per the written report of Kalawati Devi submitted to the Station House Officer of Koransarai Police Station is to the effect that on 14.07.2018 at 4.00 P.M., in the background of land dispute, all the 11 FIR named accused persons including the petitioners came and assaulted the informant, her husband, daughter and younger son

It is submitted by learned counsel for the petitioners that the petitioners are the agnates of the informant and in the background of land dispute, the accusation has been levelled against the petitioners. It is further submitted that the injuries have been found superficial, simple in nature which gets reflected from the impugned order also. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.
Learned APP submits that the specific accusation of assault has been levelled against the petitioners also. Considering the accusation of assault being omnibus and general against 11 persons, nature of injury being caused and the genesis of the occurrence, coupled with the statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Court No. II, Buxar in connection with Koransarai P.S.
