JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 31-10-2018 The grievance of the petitioner in the present writ petition is against the interim arrangement made by the University by way of posting of respondent No. 4 as In-charge Principal of the college in question. The petitioner claims that he is senior most teacher and as such entitled to continue as Professor In-charge.

2. This writ petition was filed in 2013. We are in 2018. With the passage of time the Court has reason to believe that the petitioner has lost interest and that is why no one is appearing on behalf of the petitioner either to assist the Court or pray for any adjournment on account of the difficulty which the petitioner's counsel is facing in assisting the Court today.

Since the matter is old one and neither the petitioner is present to assist the Court nor there is any counter affidavit to enlighten the Court about the actual factual position, the writ petition is disposed of, as neither the petitioner nor the respondent is interested in adjudication of the case, with observation that in case the post of regular Principal of the college in question is lying vacant, the University will take step to appoint regular Principal of the College in order to obviate the problem of In-charge Principal. Necessary decision for appointment and posting of regular Principal in the college in question must be taken by the University at the earliest preferably within a maximum period of four months from the date of receipt/production of a copy of this order.

4. With the aforesaid, the writ petition stands disposed of.
