Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 I.P.C. and 30(a) of Bihar Wine Prohibition and Excise Act, 2016.

Liquor was recovered from a four wheeler. Though the petitioner was not arrested at the spot but local Chaukidar said that the petitioner and others fled away leaving the vehicle. Motorcycle of the petitioner was seized from the place of recovery of liquor. Petitioner is accused in three more cases of identical nature, however, he is in custody since 16.09.2020. Investigation of the case is already complete. Considering the facts of this case aforesaid, let the petitioner, above named, be released on bail after framing of the charges so that the trial may not hamper on furnishing

Patna High Court CR. MISC. No.2067 of 2021(5) dt.07-07-2021 2/2 bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Vibhutipur Police Station Case No.202 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.

(d) If the learned Trial Court would come to the notice that the petitioner was involved in identical offence in future that would be a ground for cancellation of bail in this case also. (Birendra Kumar, J) Nitesh/- U T
