2. The petitioner seeks bail in connection with Rani Talab P.S. Case No. 138/2024 registered for the offence punishable under Sections 420/120(B)/34 of the Indian Penal Code and Sections 30(a)/41(1) of the Bihar Prohibition and Excise Act.
3. 657 litres of illicit liquor has been recovered. The petitioner is in jail since 16.04.2024 and he has clean antecedent.
4. The petitioner is ready to deposit Rupees Fifty Thousand in some charitable organization without accepting his guilt.
5. Learned Additional Public Prosecutor appearing on
Patna High Court CR. MISC. No.50128 of 2024(2) dt.24-07-2024 2/2 behalf of the State has vehemently opposed the prayer for bail.
6. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Danapur, Patna / concerned court in connection with Rani Talab P.S. Case No. 138 of 2024, subject to the condition s that the petitioner shall deposit Rs. 50,000/- (Fifty Thousand) only in Ramakrishna Mission Ashrama, Nala Road, Machua Toli, Patna and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
