JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-06-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 493/34 of the Indian Penal Code and and under sections 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner and specific allegation of committing rape is against his brother Avinash Kumar and petitioner has been roped in this case merely because he is brother of said co-accused. In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Munger in Sangrampur Police Station Case No. 150 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
