Let the defect(s), if any, be removed within four weeks after complete start of the physical Court. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of liquor. Petitioner has got identical criminal antecedent.
In the past, prayer for bail was refused on 28.04.2021 with liberty to the petitioner to renew the prayer after completion of six months of custody or after framing of the charges.
Submission is that charges have already been framed and the petitioner has already completed six months of custody. Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.57791 of 2021(2) dt.27-10-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sakra Police Station Case No. 528 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
