This application, for grant of anticipatory bail, arises out of Teghra Police Station Case No. 198 of 2005, disclosing offences under Sections 302, 201 and 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. rather his name has surfaced in this case during course of investigation. There is no specific allegation against the petitioner. Hence, the petitioner deserves the privilege of anticipatory bail.
Patna High Court Cr.Misc. No.45080 of 2017 (3) dt.24-11-2017 Learned A.P.P. for the State has opposed the prayer for bail and submitted that charge sheet has been submitted against the petitioner showing him absconder. Therefore, the petitioner does not deserve the privilege of anticipatory bail. Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of this petitioner is rejected.
