Learned counsel for the petitioners is expected to honur his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioners are apprehending his arrest in a case registered for the offences punishable under Sections147, 148, 149, 341, 342, 324, 307, 447, 448, 379, 506/34 of the Indian
Patna High Court CR. MISC. No.3274 of 2021(2) dt.03-11-2021 2/3 Penal code.
As per First Information Report, FIR named accused persons entered into the house of the informant and at the point of pistol have taken Rs. 1 lakh cash from his possession. It has further been alleged that co-accused, Miraj inflicted Farsa blow on Md. Rizwan.
Learned counsel for the petitioners has submitted that there is no specific allegation on the petitioners rather the allegation is omnibus and general in nature. The petitioners have no criminal antecedent.
In paragraph No.7 of the bail petition, it has been mentioned that there was old dispute between the parties and it was the reason of false implication of the petitioners. As there is no specific allegation against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Sheohar, in connection with Tariyani Chapra P.S. Case No.45 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
Patna High Court CR. MISC. No.3274 of 2021(2) dt.03-11-2021 3/3 Office shall ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 2 hereinabove, failing which the matter shall be brought to the notice of this Court.
