Petitioner seeks regular bail in a case registered for the offence punishable under Section 307, 379, 384, 385 and some other allied Sections of the Indian Penal Code. As per the prosecution case, this petitioner is alleged to have abused and assaulted the informant and also snatched his bicycle, 7 kgs. Mustard oil and other articles. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that petitioner runs a Line Hotel near his village and informant also runs a Kirana shop from whose

No.57811 of 2021(3) dt.10-02-2022 2/2 Kirana shop petitioner purchases articles for his Line Hotel and some dispute arose regarding accounting bill for which some altercation took place in which both sides sustained simple injuries but informant lodged the FIR while petitioner was waiting for Panchayati. The police after investigation submitted charge sheet u/s 341, 323, 379, 384, 385, 504, 506 of the IPC and allegation u/s 379 of the IPC is ornamental. Petitioner claims clean antecedent and is in custody since 08.07.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur (Goradih) PS case No.206/2021.
