The petitioner apprehends his arrest in Agamkuan P.S. case No. 290 of 2016 for the offences punishable under Section 419, 420, 408, 467, 468, 471, 120B of the Indian Penal Code.
The informant, General Manger of Prema Motors Pvt. Ltd., alleged that petitioner and other employees of the company are working in sales and accounts division of the company. The informant alleged that petitioner and other accused persons issued receipts showing receipt of Rs. 2,05,251/- in the company.
The learned counsel for the petitioner submits that petitioner is working in sales division of the company and it is the
Patna High Court Cr.Misc. No.43438 of 2017 (3) dt.03-10-2017 2/2 duty of the employees who work in account division to issue any cheque or receipt of money. Jashu Kumar and Shashi Shekhar are alleged to have put up the cheque for signature but Jashu Kumar has already been granted anticipatory bail by this court vide order dated 11.09.2017 passed in Cr. Misc. No. 35705 of 2017. The petitioner has specifically stated that he did not issue any receipt and none of receipt bears his signature.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, Patna in connection with Agamkuan P.S. case No. 290 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
