The petitioners apprehend their arrest in Muffasil P.S. Case No. 206 of 2017 registered for the offences punishable under Sections 341, 323, 354A, 354B, 427, 307, 379 and 34 of the Indian Penal Code.

The informant named the petitioners and others and alleged that the accused persons caught her to outrage her modesty and they started dragging her towards the field. The accused persons torn her clothes. Chhotan Das assaulted her husband Nawal Das with Pharsa on the right leg of her husband. No

Patna High Court Cr.Misc. No.34795 of 2017 (2) dt.11-08-2017 specific allegation is made against the petitioners. Learned counsel for the petitioners submits that the informant on the same and similar allegation lodged Muffasil P.S. Case No. 104 of 2017 on 13.03.2017 and the informant after one month lodged the present case. Chhotan Das is alleged to have assaulted with Pharsa who is not the petitioner here. There is a land dispute between the two sides and there is counter version also. The injuries found on the informant and her husband are simple in nature.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in Muffasil P.S. Case No. 206 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
