That this is an application for issuance of appropriate writ order or direction to quash the encroachment case no. 12 of 2021/2022, pending before the Circle Officer, Chhauradano, made over the land of the petitioner, who is residing over the same since more than 100 years with his family members. It is further prayed to restrain the respondents from initiating coercive action against the peaceful possession of the petitioner and his family members and further be pleased to direct the respondents to take legal appropriate action against respondent no. 5, namely, Rajesh Kumar, for encroaching public

At the outset, the learned counsel for the RespondentState submits that the encroachment proceedings, qua the petitioner herein, have been dropped, hence, the present writ petition has been rendered infructuous, which is not disputed by the Ld. Counsel for the petitioner.
