This application is for grant of regular bail in connection with Complaint Case no.1323 C of 2017 for the offences under Sections 498A of the Indian Penal Code. Allegation against the petitioner is of demand of dowry and torture as well as outing O.P.no.2 and on appearance of O.P.no.2 vide order dated 8.3.2019, the matter was referred to the District Mediation Centre, Nalanda at Biharsharif and the report of the District Mediation Centre has been received which shows that in spite of the efforts taken by the mediator, the petitioner is not ready to keep her and he is not paying expenses to his wife.

Patna High Court CR. MISC. No.69504 of 2018(6) dt.20-06-2019 2/2 Submission of the learned counsel for the petitioner is that the petitioner is of unsound mind and the allegation is false and concocted.

Heard learned A.P.P. but nobody appears on behalf of O.P.no.2. From the report of the mediator it does not appear that the petitioner is of unsound mind..

In view of the conduct of the petitioner and the allegation, I am not inclined to grant bail to the petitioner, however, let the petitioner surrender before the learned court below and make prayer for regular bail, which will be considered on its own merit without being prejudiced by the order of this Court.
