JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kesariya P.S. Case No. 116 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a) and 41 of Bihar Prohibition and Excise Act.

Allegation is of manufacturing of liquor against the petitioner and police raided the place and recovered huge quantity of liquor and the articles for manufacturing liquor and petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that he has falsely been implicated and he has no criminal antecedent.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.43845 of 2019(2) dt.17-07-2019 2/2 anticipatory bail stating that there is specific allegation against the petitioner and, as such this application is not maintainable. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail. With the above observation, this application is dismissed.
