JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2015 Petitioners are languishing in custody since 21.10.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 353, 427 of the I.P.C. It is alleged that informant being Home Guard received information from In-charge, Fire Brigade services about arson taking place in Forbesganj. Thereafter he along with others proceeded to the place of arson where the miscreants sprinkled diesel and petrol on the vehicle of the Fire Brigade and tried to put it on fire. Some of the miscreants assaulted with rod on the neck of the informant as a result he fell down.
It is submitted by learned counsel for the petitioners that accusation is against the mob and the chargesheet has not been submitted under Section 307 of the I.P.C when for the same occurrence three cases were lodged and out of three cases the petitioners are on bail in two cases.

Case No. 274 of 2011.
