====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-01-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 353, 354, 379, 427, 504 and 506/34 of the Indian Penal Code and Section 4 of Bihar Medical Institution Service & People Protection Act, 2011, registered in connection with Ramgarh (Nuaon) P.S.Case No.204 of 2017.

Dr. Md. Noor Alam, who is Ayush doctor in P.H.C. Nuaon, has lodged the FIR, mentioning therein that he was

Meanwhile, 50-60 people from the village Marra came there equipped with sticks, weapons etc. The petitioner Pankaj Tiwary along with other accused persons caught the informant and dashed him on the wall and asked everyone to leave the hospital. Thereafter they damaged and destroyed the cooler, chair, vaccine carrier etc. In paragraph no.3 of the bail petition, it has been mentioned that the petitioner is a man of clean antecedents and there is no other criminal case pending against him. It has also been submitted that on similar footing co-accused Musan Choubey has been granted anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 58305, vide order dated 19.12.2017.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Kaimur at Bhabua in connection with Ramgarh (Nuaon) P.S.Case No. 204 of 2017, subject to the conditions as laid down under Section 438(2) Cr. P.C.
