JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 The petitioner is languishing in custody since 16.02.2015 in connection with Budhuchak P.S. Case No. 39 of 2014 for the offences instituted under Section 304(B)/34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 20.12.2014, the husband of the deceased, namely, Rajesh Mandal, who is the son-in-law of the informant came on 20.12.2014 and his daughter went with her husband on cycle. It is further alleged that the son of the informant made a call to the informant that an occurrence has been occurred in the field of Kailash Poddar, thereafter, the informant reached in the field of Kailash Poddar where his

Patna High Court Cr.Misc. No.15319 of 2015 (2) dt.08-06-2015 2 / 3 daughter was found dead. The informant further alleged that his son-in-law, namely, Rajesh Mandal, was demanding Rs. Four Lacs for the purpose of job since last four months and further he has threatened to the informant that if you will not make the payment then your daughter will be killed and he will be remarried. The informant further alleged that due to this reason, his daughter was killed by the husband of the victim lady in connivance with the petitioner who is Bahnoi of the husband of the deceased and maternal brother, namely, Sambhu Mandal, by strangulation and the dead body was thrown away in the bush near the field of Kailash Poddar.

It has been submitted on behalf of the petitioner that the petitioner is the Bahnoi of the husband of the deceased and he has got no concern with the family affairs of the husband of the deceased. Further it has been submitted that the petitioner has no criminal antecedent and he is in custody since 16.02.2015. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class,
