The petitioner no. 1/Ashok Rai seeks bail in anticipation of his arrest in connection with Mahnar P.S. Case No. 150 of 2020 dated 23.05.2020 instituted for the offences under Sections 341, 323, 427, 324, 325, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner no. 1 along with Manoj Kumar Rai is said to have assaulted the informant and others as a result of which the informant has received injuries. The injury received by the informant and another victim has been reported to be simple in nature.

There is a counter version of the occurrence also.

Patna High Court CR. MISC. No.17388 of 2021(3) dt.06-04-2022 2/2 Manoj Kumar Rai/petitioner no. 2, whose bail application was earlier withdrawn as he was arrested during the pendency of this petition, has been granted bail by the court below.

Considering the general nature of accusation against the petitioner no. 1/Ashok Rai, the counter case and that the victim has received only simple injury and person similarly situated has been granted bail by the court below, he is also directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 150 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The petition stands allowed and disposed off accordingly.
