JUSTICE SANJAY KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and leaned Additional Public Prosecutor of the State.

The petitioner is apprehending his arrest in connection with Karjain P.S.Case No. 03/2017 registered for offences punishable under Sections 366 / 34 of the Indian Penal Code. The informant has alleged that his granddaughter was made traceless by the F.I.R. named accused persons with intention to marry her.

Learned counsel for the petitioner submits that the victim is aged about 19 years, which is reflected from the written report that she was married to Mukesh Kumar @ Birendra Mehta . The petitioner is the mother of said Mukesh Kumar @ Birendra Mehta.

Having similarly situated co-accused, Kamal Mehta, who is the Maternal Uncle of the said Mukesh Kumar, has been allowed anticipatory bail by a Co-ordinate Bench of this Court on

Patna High Court Cr.Misc. No.39376 of 2017 (2) dt.19-08-2017 2/2 06.07. 2017 in Cr. Misc. No. 15275 of 2017. There is general and omnibus allegation against the petitioner and she deserves anticipatory bail.

Learned Additional Public Prosecutor opposes the prayer for bail.

On perusal of F.I.R. I find that the petitioner is mother of Mukesh Kumar @ Birendra Mehta and the other coaccused has been allowed anticipatory bail, so the prayer of Anticipatory bail of petitioner is allowed and she in the event of arrest or surrender before the Court below within a period of six weeks, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each in connection with Karjain P.S.Case No. 03 of 2017 to the satisfaction of Sri A.K. Pandey, learned Judicial Magistrate, Birpur ( Supaul), subject to the conditions laid down under Section 438 ( 2) Cr.P.C.
