Petitioner apprehends his arrest in Nimchak Bathani P.S. Case No.56 of 2017 instituted for the offence under Section(s) 341, 323, 324, 337, 307, 379/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Gaya. Allegation against the petitioner is that he assaulted the informant and his uncle with Khanti on their head. Uncle of the informant also sustained fracture injury in his hand. It is alleged that Raj Ballabh Yadav assaulted the father and mother of the informant.

Case diary has been received in which Injury Reports are available, wherein, doctor has found injury over the head of both the informant and his uncle-Ambika Yadav. The

Patna High Court Cr.Misc. No.39268 of 2017 (3) dt.08-09-2017 2/2 doctor has found lacerated wound over left parietal region of the informant- Rajesh Kumar. Four injures were found on the person of his uncle out of which one injury on the scalp was found to be grievous.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law on its own merit without being prejudiced by this order.
