The petitioner is apprehending his arrest in connection with L.N.M.U. P.S.Case No.303 of 2017, registered for offences punishable under Sections 341, 323, 498A, 504, 34 of the Indian Penal Code.

Allegation against the petitioner is that he has subjected his wife to torture with respect to demand of dowry and assaulted her but the matter was pacified any how but again he started demanding dowry and ousted her from the house. Submission of the learned counsel for the petitioner is that she is second wife and from the first wife, he has three children and she used to ill treat his three children and father-inlaw. Further the petitioner is still paying some amount to her in her maintenance.

Heard learned A.P.P. and the learned counsel for the

Patna High Court CR. MISC. No.71393 of 2018(3) dt.16-04-2019 2/2 O.P.no.2, who has opposed the prayer for bail. It appears that the matter was referred to the Mediation Centre also but it appears that in spite of serious efforts, the dispute between the parties could to be resolved. Having heard both sides and in view of the facts and circumstances, as stated above, the petitioner, above named, is directed to surrender before the court below within a period of six weeks from the date of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of CJM, Darbhanga District Darbhanga in connection with LN.M.U. P.S.Case No.303 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will pay Rs.2,500/- (Rupees Two Thousand and Five Hundred) per month to the O.P.no.2 till the matter is decided in maintenance case, if any filed by the O.P.No.2.

With the aforesaid observation, this application is disposed of.
