The issue raised in the present writ application is no more res integra. The decision of the Division Bench in LPA No. 756 of 2015 is settler on the point.

Considering the aforesaid, the present writ application is disposed of with a direction to the respondent to take appropriate decision with regard to the claim of the petitioner on the line of decision in LPA No. 756 of 2015. Necessary decision in this regard shall be taken to the respondents at the earliest

Patna High Court CWJC No.14228 of 2019(2) dt.17-07-2019 2/2 preferably within a period of 60 days from the date of receipt/production of copy of this order and the respondents after decision may provide monitory benefit if admissible to the petitioner within a further period of 30 days.
