JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-12-2022 Heard Mr. Bashishtha Narain Mishra, learned counsel for the petitioner and Md. Iftekhar Mahmood, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Shikarpur P.S. Case No. 65 of 2021 registered for the offence punishable under Section 379 of the Indian Penal Code 1860.

As per the First Information Report, the Motorcycle of the Informant was stolen by unknown person.

Learned counsel for the petitioner submits that the

No.48535 of 2022(2) dt.16-12-2022 2/3 petitioner has been made accused in this case on the basis of confessional statement of the co-accused Hashmuddin Mian who has been granted bail by this Hon'ble Court. He further submits that name of other co-accused persons were also disclosed in the confessional statement of Hashmuddin Mian and they have been granted bail by this Court in Cr. Misc. 69097 of 2021. The petitioner is in custody since 13.7.2021 and charge sheet has already been submitted. Regards being had to the submission made by the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 13.7.

2021, charge sheet has already been submitted and other coaccused persons have been granted bail by this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Shikarpur P.S. Case No.

Patna High Court CR. MISC. No.48535 of 2022(2) dt.16-12-2022 3/3 the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
