2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks bail in connection with Paliganj P.S. Case No. 64 of 2024 dated 12.02.2024 registered for the offences punishable under Sections 379 and 461 of the I.P.C.

4. As per the prosecution case, on 11.02.2024, an unknown thief after breaking the lock of the office of Utkramit Madhya Vidayala, Fatehpur, West, stole several registers/documents and one bag of Masoor Dal of the said school.

5. Learned counsel for the petitioner has submitted that

It is submitted that the petitioner is not named in the F.I.R. He has been remanded in the present case on 04.04.2024 from Paliganj P.S. Case No. 65 of 2024 in which he confessed about the present occurrence. Except for his confessional statement in Paliganj P.S. Case No. 65 of 2024, there is no other substantive evidence to suggest his implication in the present case. The petitioner has no concern with the alleged offence. It is further submitted that nothing incriminating article has been recovered in the present case and the alleged recovered articles in connection with Paliganj P.S. Case No.

65 of 2024 are highly doubtful as the same were made in presence of the official witnesses without compliance of Section 100 of the Cr.P.C. and the recovered articles have not been put on T.I. Parade. The charge sheet has already been submitted in the present case under Sections 379 and 461 of the I.P.C. The petitioner has six criminal antecedents and in five cases, he is on bail as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 04.04.2024.

6.Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Danapur, in connection with Paliganj P.S. Case No. 64 of 2024 with further condition:- I. The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.

8. The application stands allowed.
