The petitioner apprehends his arrest in Magadh University P.S. Case No.19 of 2019 registered under Sections 413, 414 and 34 of the Indian Penal Code and under Section 11(b)(e) (f) of Animal Cruelty Act.

The police on secret information intercepted two containers and the driver of one container was apprehended, who disclosed his name as Sahadat Ansari and also disclosed the name of other driver of container as Sonu Khan, who manged to flee away. Altogether 45 animals were loaded on the containers. Learned counsel for the petitioner submits that the petitioner is the owner of one container. The petitioner was plying his vehicle on hire and it was the driver, who loaded the animals. The animals have already been released in favour of

Patna High Court CR. MISC. No.44605 of 2019(2) dt.19-07-2019 2/2 persons, who had purchased the animals.

Having considered the facts and the nature of allegation made against the petitioner and the fact that the petitioner is the owner of one of the containers, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IX, Gaya in connection with Magadh University P.S. Case No.19 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
