2. Petitioner apprehends his arrest in a case registered for the offence punishable under section 317 (5) and 111 ( 2 ) of BNS and 30(a) of the Bihar Prohibition and Excise Amendment Act 2022 .
3 . As per the prosecution case , total 27 liters country made liquor was recovered from different vehicles.
4. Learned counsel for the petitioners submits that petitioner is neither owner nor driver of the seized vehicles. The name of the petitioner transpired on the basis of confessional statement of co-accused person who was apprehended on the spot. No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected
Patna High Court CR. MISC. No.46431 of 2025(2) dt.17-07-2025 2/2 with the aforesaid recovery . Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition .

Considering the aforesaid facts, clean antecedent of petitioner and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Session Judge IV- cum- special Excise Court No. - II Gopalganj in connection with Kuchaikote P. S. Case No. 117 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
