JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report and it is an admitted position that in the first information report, informant claimed that three F.I.R. named accused persons committed rape on her. Furthermore, the informant has nowhere stated in her ferdbeyan that except the F.I.R. named accused persons, there was any other person also in commission of the alleged crime. Moreover, when the statement of informant was recorded on 17.09.2014, she added the name of the petitioners in her statement.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released

Patna High Court Cr.Misc. No.6042 of 2015 (2) dt.13-02-2015 on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Saharsa in connection with Nauhatta P.S. Case No. 173 of 2014 corresponding to POCSO Case No. 23 of 2014.
