Petitioner is apprehending arrest in connection with Banka (Barahat) P.S. Case No. 888 of 2016 registered under sections 379 of the Indian Penal Code.
FIR was lodged against unknown. The name of the petitioner surfaced on the confessional statement of co-accused. Learned counsel for the petitioner submits that he is innocent and nothing was recovered from the possession of the petitioner or from the house of the petitioner. Referring to para-3 he submits that petitioner has no criminal antecedent.
Considering the fact that FIR was registered against unknown and the petitioner has no criminal antecedent, the
Patna High Court Cr.Misc. No.47309 of 2017(5) dt.27-02-2018 2/2 court is inclined to grant bail to the petitioner, let the petitioner named above, be released on bail in the event of arrest or surrender before the court below within a period of one month from the date of receipt/production of a copy of this court, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Banka, Sri Roushan Kumar or successor court in connection with Banka (Barahat) P.S. Case No. 888 of 2016 subject to the conditions as laid down under section 438(2) of the Cr.P.C.
