JUSTICE BIRENDRA KUMAR ORAL ORDER 21-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 120(B)/34, 409, 420, 467, 468, 471 of the I.P.C., Section 13(2) read with Section 13(1)(c) and 13(1)(d) of the Prevention of Corruption Act, 1988. Petitioner is one of the accused of notorious Srijan Scam. The petitioner is in custody since 12.08.2017. Co-accused Pankaj Kumar Jha was allowed bail by the Hon'ble Apex Court considering the period of custody of Pankaj Kumar Jha and completion of investigation vide order dated 17.07.2020 passed in Cr. Appeal No. 484 of 2020 and thereafter, several accused were allowed bail by different Benches of this Court including by this Bench.

Patna High Court CR. MISC. No.10237 of 2021(3) dt.21-08-2021 2/2 Learned counsel for the C.B.I. opposed the prayer for bail.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with RC 15/A/2017, giving rise to Special Case No. 13/2020 arising out of Kotwali (Adampur) P.S. Case No. 508 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
