The petitioner apprehends his arrest in Fatuha P.S. case No. 379 of 2016 for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant, father of the deceased, alleged that her daughter was married to the petitioner about nine years ago and her daughter gave birth to three children but her husband used to torture her. The dead body of his daughter was found in a river. The learned counsel for the petitioner submits that, of course, the petitioner is husband of the deceased but marriage was solemnized nine years ago. The post mortem was held but no injury was found on the body of deceased. It is further submitted
Patna High Court Cr.Misc. No.34928 of 2017 (2) dt.16-08-2017 2/2 that the case has been compromised and other accused persons have already been granted anticipatory bail but from perusal of the FIR itself, it appears that petitioner picked up quarrel with his wife and the wife committed suicide.
Considering the fact that petitioner is the husband and his wife committed suicide, after being tortured by the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
