Smt. Reena Sinha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Kajra P.S. Case No. 77 of 2017 registered under Sections 406, 409, 420, 467, 468, 471 and 120(B) of the Indian Penal Code, pending in the court of Judicial Magistrate Ist Class, Lakhisarai.

The accusation is that complainant-opposite party no.2 and her husband, Late Shayamdeo Mahto opened the Shaving Account Nos. 6418 and 6817 at Basudeopur Kajra (PACS) Bank and deposited Rs.10,28,000/- till 09.06.2018, on which, aforesaid amount was matured to the tune of Rs.

But in spite of much approach by the complainantopposite party no. 2 after maturing the aforesaid amount, the money was not paid by the Kajra (PACS) Bank, where Bed Prakash Singh, Gaurishankar Singh and Smt. Renu Devi (petitioner) were the then Manager and Chairman, respectively. Learned counsel for the petitioner submits admittedly, petitioner was the Chairman of Kajra (PACS) Bank, where complainant-opposite party no. 2 has deposited the money and the money has already been matured but the money, as collected by the Bank, was distributed between the farmers but the recovery has not been made due to that reason, money of the complainant-opposite party no. 2 has not been returned.

Further submission is that petitioner has also written a letter to the District Magistrate, Lakhisarai, for realization of the money , as distributed amongst the farmers. It is further submitted that on recovery of the money, as distributed amongst the farmers within six months, the matured amount of the petitioner and her husband will be paid.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, her prayer for grant of anticipatory bail stands

The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
