Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with POCSO Case No. 74 of 2022 arising out of Islampur P.S. Case No. 303 of 2021 lodged under Sections 366A of the I.P.C. read with Section 8 of the POCSO Act.

As per the prosecution case, on the night of 07.06.2021, informant has submitted his written submission before the police that his minor daughter was kidnapped by the named accused persons including the present petitioner. Learned counsel for the petitioner submits that petitioner has not committed any offence and he is innocent.

Learned counsel submits that the alleged victim has been recovered who has narrated in her statement that she is 19 years old and submits that she got married to the petitioner and she wants to live with the petitioner.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned VIIth Additional Sessions Judge-cumSpecial POCSO Judge, Biharsharif, Nalanda in connection with POCSO Case No. 74 of 2022 arising out of Islampur P.S. Case No. 303 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
