The petitioner is an accused in a case registered under sections 302,392,406 and 34 of the Indian Penal Code. The informant named five accused persons in the F.I.R. and alleged that his nephew was killed by the accused persons. It is submitted that petitioner is not named in the F.I.R. The name of the petitioner has come in the confessional statement of co-accused Gyan Kumar.
Except the confessional statement the police did not collect any tangible evidence against the petitioner. Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond
