Petitioner apprehends his arrest in Complaint Case No.292 of 2017 for the offences allegedly committed by the petitioner under Section 498A and other minor sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the wife of the petitioner made allegation of impotency against the petitioner but prior to institution of the present case, the petitioner filed Matrimonial Case No. 22 of 2017 under Section 9 of the Hindu Marriage Act for restitution of conjugal rights and thereafter the complainant filed this complaint case. The petitioner is still ready to keep his wife with all honour and

Having considered the fact that prior to institution of the present case, the petitioner has earlier filed matrimonial case for restitution of conjugal rights and thereafter the wife filed this complaint case making all sorts of allegations against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Supaul in connection with Complaint Case No.292 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
