2. The petitioner seeks bail in connection with Fatuha P.S. Case No. 953 of 2025 registered for the offence punishable under Sections 303(2) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner is accused of committing theft of electricity wire of Rs. 39 lakhs.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 23.02.2026 having two criminal antecedents.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. The petitioner has made a self inculpatory

Patna High Court CR. MISC. No.45645 of 2026(2) dt.09-07-2026 2/2 statement while he was arrested in Harnaut P.S. Case No. 576 of 2025.

7. Considering the nature of allegation, two criminal antecedents and the self inculpatory statement of the petitioner, I am not inclined to grant bail to the petitioner.

8. Accordingly, the application stands dismissed.

9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
