JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 This is an application for grant of anticipatory bail in connection with Bihariganj P.S. Case No. 43 of 2018, disclosing offences under Section 392 of the Indian Penal Code. Allegation as per F.I.R. is of snatching mobile phone and motorcycle of the informant by some unknown persons. Later on, the name of petitioner transpired during course of investigation and it is stated that the mobile phone was given to one Ravindra Kumar @ Munna Yadav. Further it appears that the petitioner is accused in one more case.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he is not Ravindra Kumar @ Munna Yadav, rather he is Birendra Yadav @ Munna Yadav.

Patna High Court Cr.Misc. No.73749 of 2018(3) dt.25-01-2019 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the above facts and circumstances of the case and criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
