The petitioners are languishing in custody for the offence punishable under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act.
596 litres of liquor was recovered from a vehicle. Petitioners are driver and cleaner of the vehicle. Petitioners are in custody since 14.08.2020. They have stated on oath that they have got no criminal antecedent. Investigation of the case is already complete.
Considering the facts aforesaid, especially completion of investigation and no material to substantiate that the petitioners are going to tamper with the evidence, let the
Patna High Court CR. MISC. No.2090 of 2021(3) dt.24-05-2021 2/2 petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Rivilganj P.S. Case No. 294 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
(c) The petitioners shall not leave the country without permission of the trial Court.
