JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhabua P.S. Case No. 160 of 2019, G.R. No. 597 of 2019, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 506, 379, 387, 427, 307, 436 of the Indian Penal Code and Section 27 of the Arms Act. As per FIR there is allegation against the petitioner and other accused persons that they came and demanded extortion from the informant and the set the shop of the informant on fire, causing damage to the property and they have taken away Rs.40,000/- from the shop.

Submission of learned counsel for the petitioner is that he is a student and he has falsely been implicated and no specific allegation has been attributed against him. Heard learned APP, who has opposed the prayer for

In view of above facts and circumstances, I am not inclined to gran the privilege of anticipatory bail to the petitioner. However, if he surrenders and prays for regular bail, the same shall be considered on the basis of materials available on the record and, if possible, to be disposed of on the same day. This application is, accordingly, dismissed.
