JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 This is an application for grant of anticipatory bail in connection with Bhargama P.S. Case No. 162 of 2018, disclosing offences under Sections 341, 323, 324, 307, 354B, 379, 447, 504, 506/34 of the Indian Penal Code. Allegation against petitioner no.1 is of assault to the informant with farsa, allegation against petitioner no.2 is of assault by arrow, allegation against petitioner no.3 is of order giver and also allegation against petitioner no.4 is of snatching cash and ornaments.

Submission of learned counsel for the petitioners is that there is land dispute between the parties and they are agnate and moreover injury report does not show any sharp cutting

Patna High Court Cr.Misc. No.73930 of 2018(3) dt.25-01-2019 2/2 injury rather all injuries are simple in nature caused by hard and blunt substance. Further, they have no criminal antecedents. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Bhargama P.S. Case No. 162 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
