The petitioner seeks bail in anticipation of her arrest in connection with Goraul P.S. Case No. 316/2016 instituted for the offences under Sections 465, 467, 468, 471, 409/34 of the Indian Penal Code.
The accusation against the petitioner is of having obtained appointment as A.N.M. on forged documents. Learned counsel for the petitioner has submitted that she was appointed as A.N.M. in the year 2008 but the complaint regarding the illegal appointment of the petitioner
Patna High Court CR. MISC. No.1772 of 2021(2) dt.13-07-2021 2/3 came up only in the year 2014. The F.I.R. has been lodged in the year 2016 with primary allegation that for the period she worked as A.N.M., she has received the salary of Rs. Four Lakhs and odd which she has not returned. Learned counsel for the petitioner has submitted that she has already left the job and has not even been noticed for the refund of that money. Apart from this, it has been submitted that there is no denying the fact that the petitioner had worked for the period that she had received the salary.
Regard being had to the background facts and the accusation pertaining only to non refund of the salary which the petitioner had received during the period of her employment, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vaishali, Hajipur, in connection with Goraul P.S. Case No.
