2. The petitioner is in custody in connection with Kadirganj P.S. Case No. 81 of 2022 for the offence punishable under Sections 420, 467, 468, 471 of the Indian Penal Code lodged on 29.01.2022 by the informant, Sanjeev Singh.
3. As per the prosecution story, the informant who is part of the Reliance Jio Info. Com. Ltd. alleged that during the monthly sample testing, two SIMs were found to be without proper document which followed the F.I.R.
4. Learned counsel for the petitioner submits that two SIMs have been found to be suspicious, one in the name of Nandu Prasad and the other in his name. Neither he at any point of time made application nor he was using the said SIM,
Patna High Court CR. MISC. No.46582 of 2025(2) dt.30-07-2025 2/3 someone impersonated and result is that despite having no criminal antecedent, he is in custody since 25.04.2025.
5. Learned APP opposes the prayer for bail and submits that one of the SIMs was in the name of this petitioner.

Considering the submission of the parties as also that the categorical submission of the petitioner is that he never used the SIM, F.I.R. is there, investigation will take the police to the main culprit, he is in custody since 25.04.2025 having no criminal antecedent, in that background, this Court is inclined to extend him the privilege of bail with conditions.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Kadirganj P.S. Case No. 81 of 2022 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
Patna High Court CR. MISC. No.46582 of 2025(2) dt.30-07-2025 3/3 (iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
