====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant.
The petitioners apprehend their arrest in connection with Jurawanpur P.S. Case No.01 of 2017 registered under Sections 341, 498(A) and 504/34 of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act. The accusation is of torturing the informant by her husband and other in-laws for non-fulfillment of the dowry demand and also poured the acid on her forcibly, due to which she sustained burn injury on her leg.
Patna High Court CR. MISC. No.73664 of 2018(3) dt.22-05-2019 2/2 Learned counsel for the petitioners submits that the petitioners are brothers-in-law of the informant and have falsely been implicated in this case with general and omnibus allegation. Further submission is that in the case diary, which is up-to paragraph-84, there is no injury report of the informant. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Vaishali at Hajipur, in connection with Jurawanpur P.S. Case No.01 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
