2. The petitioner seeks bail in connection with Kharagpur P.S.Case No. 197 of 2023 registered for the offence punishable under Sections 25 (1-A), 25 (1-AA), 25 ( 1-B)A, 26 (1)(2) of the Arms Act.

3. Earlier, the bail application of the petitioner was rejected vide order dated 05.03.2024 passed in Cr. Misc. No. 79530 of 2023

4. Learned counsel for the petitioner has submitted that petitioner is in custody since 11.04.2023.

5. Learned counsel for the petitioner has taken this Court through the impugned order, from which it appears that the petitioner is suffering from chronic ailment of Kidney and

Patna High Court CR. MISC. No.54658 of 2024(2) dt.31-08-2024 2/2 required specialized treatment.

6. Considering the fact the petitioner is in jail since 11.04. 2023 and required specialized treatment for his Kidney ailment, this application is allowed.

7. Let the above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Munger in Kharagpur P.S.Case No. 197 of 2023.

8. As a condition of this order, the petitioner, after being released on bail, is directed to mark his attendance at Jamalpur Police Station once in a month. Any default in appearance at the Police Station will result in cancellation of bail bonds of the petitioner.
