This application, for grant of anticipatory bail, arises out of Darbhanga Town P.S. Case No. 74 of 2018, disclosing offences under Sections 341, 323, 504, 498(A)/34 of the Indian Penal Code.
Earlier on appearance of both the parties, the matter was referred to Patna High Court, Mediation and Conciliation Centre, Patna vide order dated 27.02.2019 and the report of learned Mediator is also available on record, from which, it appears that the dispute between the parties has been resolved with certain terms and conditions mentioned in the Memorandum of Agreement.

No.75113 of 2018(4) dt.11-04-2019 2/2 Having heard the parties, considering the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Town P.S. Case No. 74 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is made clear that the petitioner will abide by the terms and conditions mentioned in the Memorandum of Agreement, otherwise, opposite party no. 2 will be at liberty to move for cancellation of bail bonds of the petitioner.
