JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Durgawati P.S. Case No. 109 of 2019, disclosing offences under Sections 447, 341, 307, 323, 354, 504, 34 of IPC.

Allegation against the petitioners is that they came at the door of the informant, abused and misbehaved with her, on hulla, her son reached there and they also assaulted, causing injury to him.

Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties and the injuries are simple in nature. Apart from that he is an

Patna High Court CR. MISC. No.47353 of 2019(2) dt.30-07-2019 2/2 accused in one more case, but the same has been lodged by the informant herself and they are ready to abide by any condition imposed upon them.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Durgawati P.S. Case No. 109 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that they will not threaten the informant or in any way disturb the family life of the informant, otherwise, their bail bonds shall be cancelled.
