2. Petitioner seeks regular bail in connection with Saur Bazar P.S. Case No. 53 of 2025 dated 24.02.2025 registered for the offences punishable under sections 25(1-B)(a) and 26 of the Arms Act.
3. The main submissions advanced by petitioner's counsel are that as per the allegation, from the dicky of the petitioner's motorcycle, one country made katta and two live cartridges were recovered but the said allegation is completely false and fabricated by the police after their illegal demand was not fulfilled by the petitioner. It is further submitted that the petitioner has fair and clean antecedent and has been
Patna High Court CR. MISC. No.46821 of 2025(2) dt.01-08-2025 2/2 languishing in jail since 25.02.2025 and against him the investigation has been completed. It is lastly submitted that the alleged offences are triable by the court of Magistrate and most of the material witnesses, who are to be examined in the trial of the petitioner are police personnel, so, the release of the petitioner will not affect the prosecution in any manner.
4. Learned APP for the State has opposed the prayer of the petitioner.
5. Considering the aforesaid submissions and mainly the petitioner's custody period and his fair and clean antecedent, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Saur Bazar P.S. Case No. 53 of 2025.
