JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 420,467,468,471,504,506 and 120B of the Indian Penal Code. It is alleged by the informant that the informant being a Film Financer, Producer and Distributor was shocked with a wrong reporting in a magazine in the name and style of "Complete Cinema"with regard to a judgment in T.S. No. 148 of 2003 delivered against him. The petitioner is the proprietor of the alleged magazine.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.9863 of 2015 (2) dt.11-03-2015 that considering the nature of the accusation, the co accused Kul Bhushan Gupta has been granted anticipatory bail vide Cr. Misc. No. 18291 of 2010.

This court is not inclined to interfere in the matter only because the case was instituted in 2010 but since co accused has been granted anticipatory bail by this court, the aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Munger Kotwali P.S. Case No. 40 of 2010 pending in the court of learned CJM, Munger.

This application is disposed of with the aforesaid observation/direction.
