JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 The petitioners apprehend their arrest in connection with Kudhani P.S.Case No. 362 of 2017 registered under Sections 379 and 411 of the Indian penal Code.

Allegation, as per the FIR, is of theft of Tullu Pump from the house of the informant and one person was arrested, he named this petitioners. Further, it appears that petitioners are accused in more cases of similar type.

Submission of learned counsel for the petitioners is that except confessional statement of co-accused, there is nothing against petitioners and no recovery was made from them. Heard learned APP also.

Having heard both sides and in view of the criminal antecedents and allegation of the petitioners, as stated above, I

If petitioners surrender within a period of six weeks from the date of receipt of a copy of this order and pray for regular bail, the same shall be considered by the learned court below on its own merit without being prejudiced by this order. The application stands dismissed.
