The petitioner who is in custody since 30.05.2019 has filed the instant application for grant of bail in connection with Kawakole P.S. Case No. 235 of 20148 (District Nawada) registered for the offence punishable under sections 341,323,324,307,504 and 34 of the Indian Penal Code. As per the allegation in the FIR, as a result of altercation between the parties, the petitioner is alleged to have given a knife blow in the stomach of the son of the informant. It is submitted by learned counsel for the petitioner that a joint petition of compromise has been filed by the parties in the court below. It is further submitted that from perusal of the injury reports, it will transpire that both the injuries have been found to be simple in nature, the petitioner is in custody

Patna High Court CR. MISC. No.44263 of 2019(3) dt.16-10-2019 2/2 since 30.05.2019 and has no criminal antecedent. The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation of assault by the petitioner with knife on the son of the informant which is supported by the injury reports, the Court is not inclined to enlarge the petitioner on bail and as such the application for bail is rejected.
