2. This application has been filed for cancellation of the regular bail granted to Opposite Party Nos. 2 and 3 vide order dated 28.08.2024 passed by the learned Court of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 407 of 2024, registered for the offences punishable under Sections 341, 307, 386/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. From the records, it appears that the impugned order granting bail to Opposite Party Nos. 2 and 3 has been
Patna High Court CR. MISC. No.60438 of 2025(2) dt.22-07-2026 2/2 passed by the learned Chief Judicial Magistrate, Khagaria. However, the said order has not been assailed before the learned Principal District & Sessions Judge, Khagaria.
4. In these circumstances, this application is disposed of with liberty to the petitioner to file an appropriate application seeking cancellation of bail granted to the O.P. Nos. 2 and 3 before the Principal District & Sessions Judge, Khagaria. If such an application is filed, the learned Principal District & Sessions Judge, Khagaria shall consider and dispose of the same on its own merits, in accordance with law, preferably within a period of three months from the date of its filing.
6. It is made clear that this Court has not expressed any opinion on the merits of the rival claims and all questions are left open to be considered by the learned Principal District & Sessions Judge, Khagaria.
